Risoluzione alternativa delle controversie --- 1) Ambito di applicazione 1.1 Le presenti Condizioni Generali (di seguito “GTC”) di Sanadog GmbH (di seguito “il Venditore”) si applicano a tutti i contratti per la fornitura di merci concluse tra un consumatore o un commerciante (di seguito “il Cliente”) e il Venditore per quanto riguarda le merci visualizzate dal Venditore nel suo negozio online. L’inclusione dei termini e delle condizioni del Cliente è espressamente esclusa, salvo diversamente concordato. 1.2 Queste GTC si applicano di conseguenza ai contratti per la fornitura di buoni, salvo espressa indicazione contraria. 1.3 Ai fini di queste GTC, un consumatore significa qualsiasi persona fisica che entra in una transazione legale per scopi che sono prevalentemente al di fuori del suo commercio, affari o professione. 1.4 Ai fini di queste GTC, un commerciante intende qualsiasi persona fisica o giuridica o partnership con personalità giuridica che, quando entra in una transazione legale, agisce nell'esercizio del suo commercio, affari o professione. 1.5 L’oggetto del contratto può, a seconda della descrizione del prodotto del Venditore, essere la fornitura di merci sia come consegna one-off o su base continuativa (di seguito “contratto di abbonamento”). Nel caso di un contratto di abbonamento, il Venditore si impegna a fornire al Cliente le merci dovute ai sensi dell'art il contratto per la durata concordata agli intervalli di consegna concordati. --- 2) Conclusione del contratto 2.1 Le descrizioni dei prodotti contenute nel negozio online del Venditore non costituiscono offerte vincolanti da parte del Venditore ma servono unicamente per consentire al Cliente di presentare un’offerta vincolante. 2.2 Il Cliente può presentare l’offerta tramite il modulo d’ordine online integrato nel negozio online del Venditore. In tal modo, dopo aver inserito le merci selezionate nel carrello virtuale e aver completato il processo di ordinazione elettronica, il Cliente presenta un'offerta giuridicamente vincolante per l'inserimento in un contratto rispetto alle merci contenute nel carrello facendo clic sul pulsante che finalizza il processo di ordine. 2.3 Il Venditore può accettare l’offerta del Cliente entro cinque giorni inviando al Cliente una conferma scritta dell’ordine o conferma in forma scritta (ad esempio via fax o e-mail), consegnando i beni ordinati al Cliente o richiedendo il pagamento. Se si verificano diverse di queste alternative, il contratto viene concluso quando si verifica il primo di questi eventi. Qualora il Venditore non accetti l’offerta del Cliente entro tale termine, l’offerta sarà considerata respinta. 2.4 Quando si seleziona un metodo di pagamento offerto da PayPal, l'elaborazione dei pagamenti avviene tramite PayPal (Europa) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Lussemburgo (“PayPal”), ai sensi del Contratto d’Utente PayPal disponibile presso https://www.paypal.com/de/webapps/mpp/ua/useragreement-full o, se il Cliente non ha un account PayPal, in base ai termini per i pagamenti senza un account PayPal, disponibili presso https://www.paypal.com/de/webapps/mpp/ua/privacywax-full. Il Venditore dichiara l’accettazione dell’offerta del Cliente al momento in cui il Cliente clicca sul pulsante che completa il processo di ordine. 2.5 Quando si seleziona "Amazon Pagamenti” metodo di pagamento, il pagamento viene elaborato tramite Amazon Payments Europe s.c.a., 38 Avenue John F. Kennedy, L-1855 Lussemburgo (“Amazon”), ai sensi del Contratto di Utente Amazon Payments Europe, disponibile presso https://pay.amazon.de/help/201751590. Quando il cliente seleziona “Amazon Payments” come metodo di pagamento durante il processo di ordine online, lui o lei emette anche un'istruzione di pagamento per Amazon facendo clic sul pulsante che finalizza l'ordine. In tal caso, il Venditore dichiara l’accettazione dell’offerta del Cliente al momento dell’attivazione del processo di pagamento. 2.6 Al momento della presentazione di un’offerta tramite il modulo d’ordine online del Venditore, il testo del contratto viene memorizzato dal Venditore dopo la conclusione del contratto e inviato al Cliente in forma scritta (ad esempio via e-mail, fax o lettera). Se il Cliente ha creato un account utente prima di effettuare l'ordine, i dati dell'ordine saranno archiviati sul sito del Venditore e potranno essere accessibili tramite il suo account protetto dalla password. 2.7 Prima di inviare l'ordine, il Cliente può identificare e correggere eventuali errori di input controllando attentamente le informazioni visualizzate sullo schermo. 2.8 La lingua contrattuale è tedesca. 2.9 Il trattamento degli ordini e la comunicazione di solito avvengono via e-mail. Il Cliente deve garantire che l'indirizzo e-mail fornito sia corretto in modo che le e-mail inviate dal Venditore possano essere ricevute. --- 3) Diritto di recesso 3.1 I consumatori hanno generalmente un diritto di recesso. 3.2 Le informazioni dettagliate sul diritto di recesso sono fornite nella politica di ritiro del Venditore. --- 4) Prezzi e Termini di pagamento 4.1 Se non diversamente indicato nella descrizione del prodotto del venditore, i prezzi indicati sono i prezzi totali, compresa l'IVA legale. Eventuali costi aggiuntivi di spedizione e spedizione sono specificati separatamente. 4.2 I metodi di pagamento disponibili sono comunicati al Cliente nel negozio online del Venditore. 4.3 Se il pagamento anticipato tramite bonifico bancario è stato concordato, il pagamento è dovuto immediatamente alla conclusione del contratto. 4.4 Quando si seleziona il metodo di pagamento “SOFORT”, il pagamento viene elaborato tramite SOFORT GmbH, Theresienhöhe 12, 80339 Monaco di Baviera (“SOFORT”). Stripe può utilizzare servizi di pagamento aggiuntivi, per i quali possono essere applicate condizioni separate. Ulteriori informazioni possono essere trovate in https://www.shopify.com/legal/terms-payments-de. --- 5) Termini di consegna e spedizione 5.1 Se il Venditore offre la consegna, la merce sarà consegnata all'interno dell'area di consegna specificata dal Venditore all'indirizzo di consegna fornito dal Cliente. 5.2 Se la consegna non viene eseguita per motivi attribuibili al Cliente, il Cliente dovrà sostenere eventuali costi ragionevoli sostenuti. 5.3 Se il Cliente agisce come trader, il rischio di perdita accidentale o deterioramento delle merci passa al Cliente una volta che il Venditore ha consegnato le merci al vettore. Se il Cliente agisce come consumatore, il rischio passa al ricevimento della merce. 5.4 Il Venditore si riserva il diritto di recedere dal contratto in caso di inadempienza o improprio. Il Venditore si impegna a procurare le merci. Se non disponibile, il Cliente sarà informato tempestivamente e rimborsato. 5.5 La raccolta da parte del Cliente non è possibile. 5.6 I voucher sono forniti via e-mail. --- 6) Termine e Terminizzazione dei contratti di abbonamento 6.1 I contratti di abbonamento sono conclusi per un periodo indefinito e possono essere terminati dal Cliente in qualsiasi momento senza preavviso. 6.2 Il diritto di cessare per causa rimane inalterato. 6.3 La cancellazione può essere effettuata per iscritto, via e-mail o tramite il pulsante di cancellazione sul sito del Venditore. --- 7) Conservazione del titolo Se il Venditore effettua consegne anticipate, la proprietà della merce rimane presso il Venditore fino al pagamento completo del prezzo di acquisto. --- 8) Responsabilità per i difetti (protezione) Se non diversamente previsto, si applicano disposizioni legali in materia di responsabilità per i difetti. Per i contratti di consegna delle merci si applicano le seguenti deviazioni: 8.1 Se il Cliente agisce come trader: - Il Venditore può scegliere il tipo di prestazioni successive. - Per le nuove merci, il termine di prescrizione per i reclami di difetto è di un anno dalla consegna. - Per i beni utilizzati sono esclusi i diritti di difetti. - Il periodo di limitazione non riavvia dopo la consegna di sostituzione. 8.2 Le limitazioni di cui sopra non si applicano a: - Reclami per danni e rimborso delle spese. - I difetti occultati in modo fraudolento. - I beni utilizzati per un edificio e che ha causato la sua difettosità. - Qualsiasi obbligo di fornire aggiornamenti per elementi digitali di merci. 8.3 Per i commercianti, i periodi di prescrizione legale per i diritti di ricorso rimangono inalterati. 8.4 Se il cliente è un commerciante, egli o lei deve rispettare i doveri di ispezione e notifica ai sensi della sezione 377 HGB. 8.5 Se il Cliente è un consumatore, viene richiesto di segnalare eventuali danni evidenti al vettore e di informare il Venditore di conseguenza. --- 9) Responsabilità 9.1 Il Venditore è responsabile senza limitazione: - Per negligenza o colpa grave. - Per lesioni alla vita, al corpo o alla salute. - Con qualsiasi garanzia. - Obbligatorio responsabilità legale, come la legge sulla responsabilità del prodotto. 9.2 Se il Venditore viola negligentemente un obbligo contrattuale materiale, la responsabilità è limitata a danni tipici prevedibili. 9.3 È esclusa ogni ulteriore responsabilità del Venditore. 9.4 Le disposizioni di cui sopra si applicano anche ai rappresentanti del Venditore e agli agenti vicari. --- 10) Redenzione dei buoni promozionali 10.1 I buoni promozionali emessi gratuitamente per un periodo specifico possono essere riscattati solo nel negozio online del Venditore entro il periodo specificato. 10.2 I buoni promozionali possono essere riscattati solo dai consumatori. --- 11) Redenzione dei buoni regalo 11.1 I buoni regalo acquistati tramite il negozio online del venditore possono essere riscattati solo nel

Alternative Dispute Resolution --- 1) Scope of Application 1.1 These General Terms and Conditions (hereinafter “GTC”) of Sanadog GmbH (hereinafter “the Seller”) shall apply to all contracts for the supply of goods concluded between a consumer or trader (hereinafter “the Customer”) and the Seller in respect of the goods displayed by the Seller in its online shop. The inclusion of the Customer’s own terms and conditions is hereby expressly excluded, unless otherwise agreed. 1.2 These GTC shall apply accordingly to contracts for the supply of vouchers, unless expressly stated otherwise. 1.3 For the purposes of these GTC, a consumer means any natural person who enters into a legal transaction for purposes that are predominantly outside his or her trade, business or profession. 1.4 For the purposes of these GTC, a trader means any natural or legal person or partnership with legal personality who, when entering into a legal transaction, acts in the exercise of his or her trade, business or profession. 1.5 The subject matter of the contract may, depending on the Seller’s product description, be the supply of goods either as a one-off delivery or on a continuing basis (hereinafter “subscription contract”). In the case of a subscription contract, the Seller undertakes to supply the Customer with the goods owed under the contract for the agreed duration at the agreed delivery intervals. --- 2) Conclusion of Contract 2.1 The product descriptions contained in the Seller’s online shop do not constitute binding offers on the part of the Seller but serve solely to enable the Customer to submit a binding offer. 2.2 The Customer may submit the offer via the online order form integrated into the Seller’s online shop. In doing so, after placing the selected goods in the virtual shopping basket and completing the electronic order process, the Customer submits a legally binding offer to enter into a contract with respect to the goods contained in the shopping basket by clicking the button which finalises the order process. 2.3 The Seller may accept the Customer’s offer within five days by sending the Customer a written order confirmation or confirmation in text form (e.g. by fax or e-mail), delivering the ordered goods to the Customer, or requesting payment. If several of these alternatives occur, the contract is concluded when the first of these events occurs. If the Seller does not accept the Customer’s offer within this period, the offer shall be deemed rejected. 2.4 When selecting a payment method offered by PayPal, payment processing is carried out via PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), under the PayPal User Agreement available at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full or, if the Customer does not have a PayPal account, under the terms for payments without a PayPal account, available at https://www.paypal.com/de/webapps/mpp/ua/privacywax-full. The Seller declares acceptance of the Customer’s offer at the time the Customer clicks the button finalising the order process. 2.5 When selecting the “Amazon Payments” payment method, payment is processed via Amazon Payments Europe s.c.a., 38 Avenue John F. Kennedy, L-1855 Luxembourg (“Amazon”), under the Amazon Payments Europe User Agreement, available at https://pay.amazon.de/help/201751590. When the Customer selects “Amazon Payments” as the payment method during the online order process, he or she also issues a payment instruction to Amazon by clicking the button that finalises the order. In such a case, the Seller declares acceptance of the Customer’s offer at the time the payment process is triggered. 2.6 When submitting an offer via the Seller’s online order form, the contract text is stored by the Seller after conclusion of the contract and sent to the Customer in text form (e.g. by e-mail, fax, or letter). If the Customer has created a user account prior to placing the order, the order data will be archived on the Seller’s website and can be accessed via his or her password-protected account. 2.7 Before submitting the order, the Customer can identify and correct any input errors by carefully reviewing the information displayed on the screen. 2.8 The contract language shall be German. 2.9 Order processing and communication usually take place by e-mail. The Customer must ensure that the e-mail address provided is correct so that e-mails sent by the Seller can be received. --- 3) Right of Withdrawal 3.1 Consumers generally have a right of withdrawal. 3.2 Detailed information on the right of withdrawal is provided in the Seller’s withdrawal policy. --- 4) Prices and Payment Terms 4.1 Unless otherwise stated in the Seller’s product description, the prices indicated are total prices including statutory VAT. Any additional delivery and shipping costs are specified separately. 4.2 The available payment methods are communicated to the Customer in the Seller’s online shop. 4.3 If advance payment by bank transfer has been agreed, payment is due immediately upon conclusion of the contract. 4.4 When selecting the payment method “SOFORT”, payment is processed via SOFORT GmbH, Theresienhöhe 12, 80339 Munich (“SOFORT”). To use this payment method, the Customer must have an online banking account activated for SOFORT and confirm the payment instruction. More information can be found at https://www.shopify.com/legal/terms-payments-de. --- 5) Delivery and Shipping Terms 5.1 If the Seller offers delivery, the goods will be delivered within the delivery area specified by the Seller to the delivery address provided by the Customer. 5.2 If delivery fails for reasons attributable to the Customer, the Customer shall bear any reasonable costs incurred. 5.3 If the Customer acts as a trader, the risk of accidental loss or deterioration of the goods passes to the Customer once the Seller has handed the goods to the carrier. If the Customer acts as a consumer, the risk passes upon receipt of the goods. 5.4 The Seller reserves the right to withdraw from the contract in cases of incorrect or improper self-supply. The Seller shall make reasonable efforts to procure the goods. If unavailable, the Customer will be informed promptly and refunded. 5.5 Collection by the Customer is not possible. 5.6 Vouchers are provided by e-mail. --- 6) Term and Termination of Subscription Contracts 6.1 Subscription contracts are concluded for an indefinite period and may be terminated by the Customer at any time without notice. 6.2 The right to terminate for cause remains unaffected. 6.3 Termination may be made in writing, by e-mail, or via the cancellation button on the Seller’s website. --- 7) Retention of Title If the Seller makes advance deliveries, ownership of the goods remains with the Seller until full payment of the purchase price. --- 8) Liability for Defects (Warranty) Unless otherwise provided, statutory provisions on liability for defects apply. For contracts for the delivery of goods, the following deviations apply: 8.1 If the Customer acts as a trader: - The Seller may choose the type of subsequent performance. - For new goods, the limitation period for defect claims is one year from delivery. - For used goods, defect rights are excluded. - The limitation period does not restart following replacement delivery. 8.2 The above limitations do not apply to: - Claims for damages and reimbursement of expenses. - Fraudulently concealed defects. - Goods used for a building and which caused its defectiveness. - Any obligation to provide updates for digital elements of goods. 8.3 For traders, statutory limitation periods for rights of recourse remain unaffected. 8.4 If the Customer is a merchant, he or she must comply with the duties of inspection and notification under Section 377 HGB. 8.5 If the Customer is a consumer, he or she is requested to report any obvious transport damage to the carrier and inform the Seller accordingly. --- 9) Liability 9.1 The Seller is liable without limitation: - For intent or gross negligence. - For injury to life, body or health. - Under any guarantee. - Under mandatory statutory liability, such as the Product Liability Act. 9.2 If the Seller negligently breaches a material contractual obligation, liability is limited to foreseeable, typical damage. 9.3 Any further liability of the Seller is excluded. 9.4 The above provisions apply also to the Seller’s representatives and vicarious agents. --- 10) Redemption of Promotional Vouchers 10.1 Promotional vouchers issued free of charge for a specific period may be redeemed only in the Seller’s online shop within the specified period. 10.2 Promotional vouchers may be redeemed only by consumers. --- 11) Redemption of Gift Vouchers 11.1 Gift vouchers purchased via the Seller’s online shop may be redeemed only in the
